Welcome to Lead Better HQ, a platform operated by POP Fizz, Inc., a Pennsylvania corporation doing business as Lead Better HQ ("Lead Better HQ," "we," "us," or "our"). We are committed to protecting the privacy and security of your personal information.

This Privacy Policy describes how we collect, use, process, store, and disclose your information when you visit our website at www.leadbetterhq.com, use the Lead Better HQ software platform (the "Platform"), or engage with our services.

Geographic Scope: Lead Better HQ currently provides platform and program services to clients located in the United States and Canada (excluding the Province of Quebec). If you are located outside these jurisdictions, this policy still governs your use of our website and any information we collect from you in connection with it.


1. Information We Collect

We collect information to provide and improve our Platform and Services and to operate our business effectively.

Information You Provide Directly:

Account Information: When you create an account, purchase a service, or sign up for a program, we collect personal details such as your name, business name, email address, phone number, physical address, and payment information.

Communications: Information you provide when you contact us for support, inquiries, or feedback, including through email, chat, or phone.

Form Submissions: Information you submit through website forms, surveys, intake forms, or program applications.

User-Generated Content: Any content you upload, post, or create within the Platform, including website content, email copy, automation workflows, and CRM records.

Information We Collect Automatically:

Usage Data: Information about how you interact with our website and Platform, such as pages visited, features used, time spent, and date and time of access.

Device Information: Details about the device you use to access the Platform, including IP address, browser type, operating system, and unique device identifiers.

Location Information: General location data derived from your IP address.

Information We Collect from Third Parties:

EHR Integrations: If you connect third-party EHR systems (such as Practice Better or Cerbo) with Lead Better HQ via Lead Better Connector, we may receive information from those services as authorized by you and in accordance with their privacy policies.

Marketing and Analytics Partners: We may receive information from marketing partners and analytics services to improve our services.


2. How We Use Your Information

We use the information we collect for the following purposes:

To operate, maintain, and improve the Lead Better HQ Platform and Services

To process transactions and manage your account and subscriptions

To fulfill our service obligations, including platform setup, onboarding, and EHR integration

To provide customer support and respond to your inquiries

To send service-related notifications, updates, and security alerts

To send marketing and promotional communications, where you have provided consent or where permitted by applicable law

To monitor and analyze usage trends and improve our offerings

To detect, prevent, and address fraud, security incidents, and other harmful activities

To comply with legal obligations applicable to POP Fizz, Inc. and Lead Better HQ


3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

With Service Providers and Subprocessors: We share information with third-party vendors and service providers who perform services on our behalf. Our primary subprocessors who may process your data include:

GoHighLevel — CRM, automation, email, SMS, and communications platform infrastructure. GoHighLevel operates under a Business Associate Agreement with Lead Better HQ.

Amazon Web Services (AWS) / AWS Bedrock — Cloud infrastructure and AI processing for Lead Better Intelligence. AWS operates under a Business Associate Agreement with Lead Better HQ.

Stripe — Payment processing. Stripe's privacy policy is available at stripe.com/privacy.

Other service providers — Analytics, customer support tools, and operational platforms as necessary.

All subprocessors are contractually obligated to protect your information and use it only for the purposes for which it was disclosed.

With EHR Integrations (Client-Initiated): If you integrate Lead Better HQ with third-party EHR systems, you authorize us to share information necessary for that integration to function, in accordance with your settings and the EHR platform's privacy policies. Lead Better HQ is not responsible for the data practices of third-party EHR platforms.

For Legal Reasons: We may disclose your information if required by law, court order, or legal process, or if we reasonably believe disclosure is necessary to protect our rights, enforce our agreements, or protect the safety of our users or the public.

Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of the transaction. We will notify you via email and/or prominent notice on our website of any such change in ownership.

With Your Consent: We may share your information with third parties when we have your explicit consent to do so.


4. Your Rights and Choices

All Users:

Access and Correction: You may access and update certain account information directly within your Lead Better HQ account settings. For other requests, contact us at support@leadbetterhq.com.

Marketing Communications: You can opt out of receiving promotional communications at any time by following the unsubscribe instructions in those communications or by contacting us directly.

Cookies: You can manage cookie preferences through your browser settings. Note that disabling cookies may affect platform functionality.

Data Portability: You may request a copy of the personal information we hold about you.

Deletion: You may request deletion of your personal information, subject to legal exceptions such as compliance and transaction records.

Canadian Users — Additional Rights Under PIPEDA:

If you are located in Canada (excluding Quebec), you have the following additional rights under the Personal Information Protection and Electronic Documents Act (PIPEDA):

Right to Access: You have the right to request access to the personal information Lead Better HQ holds about you and to be informed of how it has been used and disclosed.

Right to Challenge Accuracy: You have the right to challenge the accuracy and completeness of your personal information and request corrections.

Right to Withdraw Consent: Where our processing of your personal information is based on consent, you may withdraw that consent at any time, subject to legal or contractual restrictions. Withdrawal of consent may affect our ability to provide services to you.

Right to File a Complaint: You have the right to file a complaint with the Office of the Privacy Commissioner of Canada (OPC) at www.priv.gc.ca if you believe Lead Better HQ has not handled your personal information in compliance with PIPEDA.

5. HIPAA Compliance and Business Associate Agreement

Lead Better HQ is committed to supporting our US-based health practitioner clients in their HIPAA compliance efforts.

Business Associate: To the extent that POP Fizz, Inc., through the Lead Better HQ Platform and Services, creates, receives, maintains, or transmits Protected Health Information (PHI) on behalf of a Covered Entity (Client), POP Fizz, Inc. functions as a Business Associate under HIPAA.

Data Safeguards: We implement appropriate administrative, physical, and technical safeguards to protect PHI as required by the HIPAA Security Rule and Privacy Rule, including through our subprocessors GoHighLevel and AWS Bedrock, both of which operate under executed Business Associate Agreements with Lead Better HQ.

Business Associate Agreement (BAA): A separate BAA is required and will be executed with all Covered Entity clients prior to platform access. Your use of Lead Better HQ for PHI is contingent upon the execution of a BAA.

Client Responsibility: Client remains responsible for their own overall HIPAA compliance, including obtaining necessary patient consents, implementing internal policies, and using Lead Better HQ in a HIPAA-compliant manner.

Trial and Non-Production Environments: Trial and non-production environments provided by Lead Better HQ are NOT covered under any BAA and are NOT HIPAA-compliant. No PHI may be entered into any trial or non-production environment.


6. Canadian Users — PIPEDA Compliance

This section applies specifically to users and clients located in Canada (excluding the Province of Quebec).

Applicable Law: Lead Better HQ handles the personal information of Canadian users in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5, and its ten fair information principles.

Cross-Border Data Transfer: Lead Better HQ is a US-based company. Personal information collected from Canadian users is transferred to and processed in the United States. By using our website or platform, Canadian users consent to this cross-border transfer. Lead Better HQ implements safeguards consistent with PIPEDA's accountability requirements for cross-border data transfers.

Quebec Exclusion: Lead Better HQ does not currently offer platform or program services to individuals or entities located in the Province of Quebec due to the distinct requirements of Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25).

Provincial Health Privacy Laws: Canadian health practitioners are subject to provincial health privacy legislation in addition to PIPEDA (for example, PHIPA in Ontario, PIPA in British Columbia and Alberta). Lead Better HQ does not provide legal advice regarding provincial health privacy compliance. Canadian clients are responsible for ensuring their use of the platform complies with all applicable provincial laws.

CASL — Canada's Anti-Spam Legislation: Canadian clients who use Lead Better HQ to send commercial electronic messages (emails, SMS, and automated communications) to Canadian recipients are solely responsible for compliance with Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. This includes obtaining valid express or implied consent before sending commercial electronic messages, including proper sender identification, and providing a functional unsubscribe mechanism in every message. Lead Better HQ provides the technical platform through which messages are sent and is not responsible for client CASL compliance.

Privacy Officer: POP Fizz, Inc. has designated Nicole Harlow as the individual accountable for PIPEDA compliance. Canadian users may direct privacy inquiries and complaints to support@leadbetterhq.com.


7. Data Security

We implement reasonable and appropriate technical and organizational security measures designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit and at rest, access controls, and security monitoring through our infrastructure partners GoHighLevel and AWS.

No security system is impenetrable, and we cannot guarantee the absolute security of your data. In the event of a data breach, we will notify affected users in accordance with applicable law, including HIPAA breach notification requirements for US clients and PIPEDA breach notification requirements for Canadian clients.


8. Data Retention

We retain your personal information for as long as necessary to provide our services, fulfill the purposes described in this policy, and comply with our legal obligations. Upon cancellation of your account, you will have 60 days to export your data. After that period, Lead Better HQ will delete or anonymize your personal information in accordance with our data retention policy, except where retention is required by law.


9. Third-Party Links

Our website and Platform may contain links to third-party websites or services not operated by Lead Better HQ. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party sites you visit.


10. Children's Privacy

Our Platform and Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly.


11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal or regulatory reasons. We will notify you of material changes by posting the updated policy on our website and updating the Effective Date above. Your continued use of the Platform or Services after such changes constitutes your acceptance of the revised Privacy Policy.
