Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") outlines the types of conduct that are prohibited when using the Lead Better HQ software platform ("Platform") and services ("Services") provided by Lead Better HQ ("we," "us," or "our"). By accessing or using the Platform or Services, you ("Client," "you," or "your") agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your access to the Platform and Services.

1. General Prohibitions

You agree not to use the Platform or Services to:

Violate Laws: Engage in any activity that is illegal, fraudulent, or violates any applicable local, state, national, or international law or regulation, including, without limitation, laws governing intellectual property, data privacy (e.g., HIPAA, GDPR, CCPA/CPRA), anti-spam (e.g., CAN-SPAM Act, TCPA), export control, or consumer protection.

Harm Others: Engage in any activity that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

Impersonate: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

Fraudulent Activity: Engage in any fraudulent activity, including phishing, scamming, or otherwise deceiving users.

Security Breaches: Attempt to probe, scan, or test the vulnerability of the Platform or any related system or network, or breach any security or authentication measures.

Interfere with Services: Interfere with or disrupt the integrity or performance of the Platform or Services, or attempt to gain unauthorized access to the Platform or related systems or networks.

Spamming: Send unsolicited commercial communications (spam) or engage in any bulk messaging activities without proper consent and compliance with all anti-spam laws.

Malware/Viruses: Upload, post, email, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.

2. Content Guidelines

You are solely responsible for all content that you upload, post, create, or store on the Platform ("Client Content"). You agree not to upload, post, or transmit any Client Content that:

Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

Infringes upon the intellectual property rights of others (e.g., copyrights, trademarks).

Constitutes or promotes illegal activities or provides instructional information about illegal activities.

Contains any protected health information (PHI) unless you have a fully executed Business Associate Agreement (BAA) with Lead Better HQ and are handling such PHI in full compliance with HIPAA and other applicable privacy laws.

Is misleading, false, or inaccurate.

3. Email and SMS Usage

When using the Platform's email and SMS features, you specifically agree to:

Obtain and maintain all necessary consents from recipients for sending commercial communications via email and SMS.

Comply with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and all other applicable anti-spam and telemarketing laws.

Include a clear and conspicuous unsubscribe mechanism in all commercial emails.

Maintain accurate and current recipient lists and promptly remove opt-outs.

Not use purchased, rented, or third-party lists unless all necessary consents have been explicitly obtained in a verifiable manner that complies with applicable laws.

4. Consequences of Violation

Violation of this AUP may result in various actions, including, but not limited to:

Removal of prohibited content.

Suspension or termination of your access to the Platform and Services.

Reporting to law enforcement authorities.

Legal action to recover damages suffered by Brand Better or others.

5. Reporting Violations

6. Changes to AUP

We reserve the right to modify this AUP at any time. We will notify you of any material changes by posting the updated AUP on our website. Your continued use of the Platform or Services after such modifications constitutes your acceptance of the revised AUP.
